Maximum Liability: erthoe's total liability to you for any cause of action is limited to the greater of your payments to us in the prior 12 months or USD $100.
Exceptions: These limits don't apply to liability that cannot be excluded under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by our negligence.

User Indemnification
Indemnification means you agree to cover erthoe's legal costs if your actions cause us to be sued. Here's what that means.
You Agree to Indemnify Us
You agree to defend, indemnify, and hold harmless erthoe, its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your use or misuse of Solitaire Village: Farm Tycoon
- Your user-generated content
- Your violation of third-party rights or applicable law
We may choose to handle the defense of indemnified claims ourselves. If we do, you agree to cooperate fully and not to settle the claim without our written consent.
Notice: We'll give you prompt written notice of any indemnifiable claim and provide reasonable cooperation in your defense.
Write to our support team for questions about indemnification.
Resolving Disputes
We take disputes seriously. Here's our process for addressing them fairly.
Most disputes can be resolved with a simple conversation. Please email our support team first. If we can't resolve your issue within 30 days, you may proceed to formal dispute resolution.
Arbitration
If informal resolution fails, disputes will be resolved through binding individual arbitration rather than court, where permitted by law. Arbitration is faster, less expensive, and more private than litigation.
No Class Actions
You agree to resolve disputes with erthoe on an individual basis only. You waive any right to participate in class action or group proceedings.
Exceptions: Either party may seek emergency injunctive relief from a court of competent jurisdiction. Individual small claims actions are also exempt from this arbitration agreement.
For dispute resolution questions, email our support team.
